Life insurance has long been the discussion, and perhaps debate, of many professionals, and clients. There are few estate planning professionals who would argue the value that life insurance plays in a quality wealth management and estate plan. Life insurance can be one of the most powerful, and most versatile, financial vehicles in the entire financial industry.

In light of the recent Levine case – where the taxpayer won big on both the gift and estate tax issues – please join us for a very exciting presentation from none other than Martin Shenkman, CPA, MBA, PFS, AEP, JD. Most of you know Marty, as he presented to the GNJEPC countless times. He is a long-time member of the Greater New Jersey Estate Planning Council, and is a nationally known trust and estate attorney based out of Fort Lee, NJ, and NYC.

Marty is going to speak about life insurance, the role it plays both inside and outside the modern estate plan, it’s various uses, what to do and what not to do. One of the more popular life insurance planning techniques has long been “split dollar” life insurance. In a very recent – and very important – tax court case, The Estate of Levine prevailed on almost every major issue that the IRS challenged. The estate was able to get a discount on the split dollar receivable – and they also avoided penalties! This is a precedent setting case, but far more importantly, it will now be viewed as the “right way” to structure intergenerational split dollar life insurance plans. Marty is going to talk about loan regime vs. economic benefit split dollar, how and when to use them, and how to get the maximum benefits for our clients.

Marty is also going to look at the tax court's analysis in various cases and tell us how to modify the structure and operation of intergenerational split dollar arrangements so that professionals can mitigate and avoid the various problems that the IRS challenged in these cases.
